EPA did it again! another extension for SPCC.

alum-tanksOn April 1, 2009, EPA extended the deadline for SPCC (Spill Prevention and Control Countermeasures) to January 14, 201o.

Last week (June 11, 2009) EPA extended the deadline for SPCC again. The new deadline is now November 11, 2010. Click here for details.

  1. While it’s good news that the EPA listened to community feedback and extended the deadline, I wouldn’t expect any additional extensions. It seems clear that this is a hardened date and compliance by this date will be mandatory. I just wonder how many of these farms out there will get the word and be up to speed before CUPA or the local EPA officers come knocking.

  2. Thanks for your comment. Enforcement of the federal SPCC plan by state agencies is a tricky issue because the Clean Water Act does NOT allow EPA to delegate the SPCC program to the states. However, some states (like California) have incorporated the federal SPCC regulations into their state laws. California’s Health and Safety Code 25270 is a case in point.

    In California, the CUPA does not have the authority to take enforcement action under the Health and Safety Code. It can only note the absence or presence of a state SPCC plan during an inspection and refer the case to the Regional Water Quality Control Boards for enforcement.
